SECTION 01

1. Acceptance of Terms

By accessing or using digitalarresthelp.in ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use the Platform.

These Terms constitute a legally binding agreement between you ("User") and Digital Arrest Help India ("we", "us", "our"), a public-interest digital fraud prevention initiative based in Uttar Pradesh, India.

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines) Rules, 2021, and the Digital Personal Data Protection Act, 2023.

SECTION 02

2. Nature of the Platform

Digital Arrest Help India is a free, voluntary, public-interest platform designed to help Indian citizens identify and avoid digital arrest scams. We provide:

  • A crowd-sourced scam phone number verification tool
  • A phishing URL checking tool
  • A scenario analysis tool for detecting scam patterns
  • Emergency guidance and official helpline information
  • Educational content about digital arrest fraud tactics

Important: We are not an official government portal, law enforcement agency, or regulated financial institution. We are an independent, non-commercial initiative. Nothing on this platform constitutes legal advice, official law enforcement action, or a guarantee of accuracy.

SECTION 03

3. Permitted Use

You may use this Platform for lawful purposes only. Permitted uses include:

โœ…Verifying if a URL has been flagged as phishing
โœ…Submitting genuine scam reports to help other users
โœ…Accessing emergency guidance and helpline numbers
โœ…Using educational content to protect yourself and family
โœ…Sharing Platform content for fraud awareness purposes
SECTION 04

4. Prohibited Use

The following uses are strictly prohibited and may result in legal action:

โŒSubmitting false, misleading, or malicious scam reports to harm others
โŒAttempting to access, modify, or corrupt our database
โŒUsing the Platform to identify victims or facilitate scams
โŒScraping, crawling, or mass-downloading our data
โŒReverse-engineering, decompiling, or reproducing our tools
โŒImpersonating Digital Arrest Help India or its personnel
โŒUsing automated bots or scripts to interact with the Platform
โŒAny use that violates Indian law or the IT Act, 2000

Misuse of our platform to submit false scam reports about legitimate numbers or businesses may constitute defamation or harassment under Indian law. We reserve the right to report such misuse to cybercrime.gov.in.

SECTION 05

5. User Submissions

When you submit a phone number, URL, or scam report through our Platform:

  • You confirm the submission is made in good faith based on your genuine experience or knowledge.
  • You grant us a perpetual, royalty-free licence to store, display, and use the submitted data for the purpose of scam prevention.
  • You acknowledge that submitted data becomes publicly accessible (other users can view whether a number/URL has been flagged).
  • You accept sole responsibility for the accuracy of your submissions.
  • You will not submit numbers or URLs of legitimate individuals or businesses with the intention of harming their reputation.

We reserve the right to remove any submission that we believe to be false, malicious, or in violation of these Terms, without prior notice.

SECTION 06

6. Accuracy of Information

Our scam database is crowd-sourced. While we take reasonable steps to ensure quality, we cannot verify the accuracy of every user submission. Therefore:

  • A number/URL not found in our database does not mean it is safe โ€” it may simply not have been reported yet.
  • A number/URL flagged in our database reflects user reports, not an official determination of fraudulent activity.
  • Our scenario analysis tool uses pattern-matching against known scam phrases. It does not constitute expert legal or security advice.
  • Always cross-verify with official sources such as cybercrime.gov.in or the 1930 helpline.
SECTION 07

7. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Platform is provided "as is" without warranties of any kind, whether express or implied.
  • We do not guarantee that the Platform will be uninterrupted, error-free, or always up to date.
  • We shall not be liable for any direct, indirect, incidental, or consequential losses arising from your use of or reliance on the Platform, including financial losses suffered due to scams that our tools failed to detect.
  • We shall not be liable for inaccuracies in crowd-sourced user submissions.
  • Our maximum aggregate liability, if any, shall not exceed โ‚น1,000 (One Thousand Rupees).

If you are currently being scammed or have suffered financial loss, do not rely solely on our platform. Call 1930 immediately, contact your bank, and file a formal complaint at cybercrime.gov.in.

SECTION 08

8. Intellectual Property

All design, code, content, and branding on this Platform โ€” including the name "Digital Arrest Help India", our verification tools, and educational materials โ€” are the intellectual property of Digital Arrest Help India.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission, except for personal, non-commercial use or sharing links for fraud awareness purposes.

SECTION 09

9. Suspension & Termination

We reserve the right to restrict or terminate access to the Platform at any time, for any reason, without prior notice โ€” including (but not limited to) if we suspect a user is misusing our tools, submitting false data, or violating these Terms.

We also reserve the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time without liability.

SECTION 10

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of courts in Uttar Pradesh, India.

Before initiating any legal proceedings, we encourage users to first contact us at help@digitalarresthelp.in to resolve disputes amicably.
